I am at the tribunal stage of my appeal. I have been reading through the DWPs response and there is a strange sentence . Stating that the DWP has chosen not to take into consideration some of my medical notes and that they don't have to do so.
Hi lauren, Hmm that is a bit odd. I suppose it would not be relevant to consider thst eg you have had 3 difficult pregnancies, when you are saying you have limited mobility due to a car accident. However it certainly begs a question as to what they haven't considered and why. I woukd suggest writing to DWP to ask. You may or may not get an answer, if you do and it is reasonable as per my example above all is good, if you don't get a sensible answer or no response, then I would put this in a submission (your arguments to the tribunal) to the tribunal saying eg DWP acknowledge that they haven't taken into account all of my medical notes and provide no/ no plausible reason. Given the detail in my medical notes which confirms my disabilities, this tends to confirm that DWP has failed to take my disabilities/illness properly into account. I hope this helps. LL26
