I’m in Scotland and have a question.

I’be recently been put into the support group. I’m still employed by my employer but long term sick due to fibromyalgia. It will be a year at end of November I’ve been absent.

Due to my manager being late putting the correct documentation in place, a claim for half sick pay from an external insurance company I had no money apart from the esa money £77 weekly for approximately 4 months.

I received a call from my HR department telling me after all this time this insurance company was upholding my claim and would receive half my monthly salary and would pay me money owed.

I want to know what I should do as it appears to have been paid through my employer although I’m waiting to see if they send me something to tell me what I’m getting paid and how much tax etc.

I don’t want to get into trouble with the DWP but what do I have to do regarding esa. I’m happy that they know I’m not fit for work, what will happen when I telephone dwp to let them know. Will they put me off esa

I would contact your local welfare Rights Organisation who will be able to take all your circumstances into consideration; advicelocal.uk

Have you completed a WCA form, if you have, have you been placed in the support group, if you have not, then your ESA will stop after one year, so seek advice urgently.

ESA/UC is an indefinite award with scheduled reassessment, this can be done at any time once three months have elapsed from a previous Decision.

Health Insurance payments are usually treated in the same way as pensions unless the claimant has paid more than 50% of the premium.

I would expect a £1/week charge for every £2/week of the insurance, so as an example; someone receiving £100/week will have a deduction of £7.50 (£100 - £85 = £15 /2 = £7.50).

As stated in my previous post, you need to seek advice from your local Welfare Rights Organisation who will be able to take all your circumstances into consideration when giving you advice.
