Hi,

I am currently awaiting a tribunal date for PIP appeal.
I wondered if there is any case law or guidance on the following that could help me please -

I suffer from severe migraines and am taking a certain medication for them. I have had it increased as recommended by neurologist but have stopped at a level before it gets to the point I’m too drowsy to function at all.
Neurology had recommended other medications if this one doesn’t work but following discussion with GP we agreed they wouldn’t be suitable because they would make me too drowsy to care for my young children.

My concern is that this will reflect badly on the claim because it was such an issue in the initial assessors report that my medication hadn’t been increased “so my migraines must be under control” which they absolutely aren’t.

Just desperately hoping someone has some advice please? Thank you.

Hi Mco90

It is a hard post to give advice on, I would advise you to keep a day diary for a week explaining how you feel each day, what you can or cannot do.

You also need to explain about your meds, what effect they have on you and why you only take a certain amount.

I lost a case just before covid where the claimant had severe migraine and had to lay down in a blackout room, one of the reason why she lost her appeal was because she worked part time in the evening as a cleaner. I wanted to Appeal the decision but she decided not to carry on.
