So they never wrote down an answer other than they agreed with the P4. So as I said previously, you have to put in that you were not given a reason. It's also very strange that they told you to take it up with IAS - because the MR process is down to the DWP.

I can hardly believe it. I thought I'd lost a page in the box file. I wish I could screenshot it so you can see it. I wrote a long, detailed MR going through what was wrong with the P4, including how it does not reference PIP law in any way. This summary paragraph just says we agree with ATOS, you don't, phone ATOS. We not I.

There's nothing you can do about it now. Make sure in submitting your evidence that you are concentrating on the questions where you didn't score the points you expected. You may want to complain about the quality of the PA4, but it won't actually change your award. Assessors don't usually reference the law in their reports. The Tribunal panel want to know how your medical condition/s meets the PIP criteria and what information the DWP/IAS did not consider or understand at the time of your assessment.

Thank you - should they not consider how many days a week/month/year my condition affects me, this is what I meant by the law? The assessor claims I use an aid to get dressed, I don't, and glasses to read, I don't, that kind of thing, that is what I mean by the P4 not being fit for purpose, she quotes a medication I don't take, I could list all night. They seem to be implying I have a problem with the quality as though I don't like it, rather that it is incorrect. It is incorrect in many places.

Sounds like the process has been wearing you down just a tad.
Do you have access to all your medical records?
I wonder if you could do with someone who knows you and/or the system going over what evidence you have to help you with anything.
I know full well the struggle of constant appeals and tribunals will I'll health, so can empathise in your struggle

Thank you yes it has, I am very worked up by it, and feeling lost, thank you for your understanding. No I don't have anyone and my conditions keep me in the house, restricted. In the MR I went through the descriptors point by point, and they are mocking this I feel, rather than responding to it seriously. They are ignoring the conditional nature of PIP regulations, so safely, reliably, in the same time as an able bodied person. I feel obliged to continue with the appeal because we need to create case law for each other. Thanks again for the empathy, very much appreciated xx
