Hi,
I'm worried after seeing this response given by Gary to another poster on B & W
Until you have a live claim you cannot ask for a mandatory reconsideration, being told to make a new claim was correct advice, once you have a new claim you can then put in for a mandatory reconsideration in regards to the closure of your previous claim.
Is this correct?
I am appointee for my son's claim. It was closed due to too much capital.
I don't now believe his capital exceeded 16k, UC failed to deduct COL payments.
I put in an MR but had no text confirmation of receipt.
I phoned in an MR and they did complete it by phone (or so the agent said, she took all the details)
I don't really want to start any new claim until the capital my son has goes right down.
But i would like the old claim reopened as UC will need more bank statements from us to work out overpayments correctly.
And i do want them to factor in COL when working out overpayments. (Although 16k was never breeched, there were months when my son had more than the 13k declared)
Will the MR be considered at all since it was submitted after the UC claim closed?

One thing I would not advise doing is selecting a sentence from another member's post and attempting to apply it to your own circumstances regardless of the context.
Gary has outlined the standard DWP practice relating to closed UC claims. In most cases the UC agent refuses to accept a Mandatory Reconsideration on a closed UC claim and advises you to make a new one. However in your case the MR details were accepted and should now either be with a Decision Maker or in the queue. As I said previously the DWP do not have proscribed time limits within which to process a MR. This seems unfair as the claimant normally has only 30 days to make the MR.
Even though the UC claim is closed you should still have read only access to the Journal?

Thanks so much for this, David.
Yes, I do have read-only access in the journal. But there's no mention there of my phone MR (or my written one)
I am a bit worried that the written one has gone missing, since it was to the freepost address.
And - well, i'm not too sure with UC agents - they don't always get things right do they (?)
She said a claim manager would be in touch with me by 6pm last Tuesday. But that never happened.
Would it be worth my submitting one more MR to the postcoded address and recorded delivery, whilst i am still in the 30 day limit?
Or will that be total overkill, especially if then they potentially have 3 MRs all saying the same thing?
I just want to make sure they take COL into account when calculating the overpayment. They have not yet been in touch to request more statements.
I know it is going to move slowly and i'm happy to wait in line but i would feel more re assured if they would acknowledge receipt of the MR.
Apologies to Gary for pulling out his words there out of context. I also saw a thing on Rightsnet (not by Gary!) about this exact same issue where MRs on closed claims were ignored due to closed claims not having a case manager.
This is why i am a bit concerned.

I went to the Post Office this morning and posted one MR letter to the address you gave me there, David,and another exact same MR to their Canterbury address. Between all my efforts to get this info to them, they should get my message one way or another.
Both first class recorded. I am feeling much better now those are in the post. Just a waiting game now.

Thanks for the update. I forgot to mention that a MR can be handed in at a Jobcentre. Though most members of this Forum are only too keen to keep away from the Jobcentre
