Why have I been penalised for PIP because I work

hi I have worked all my life -no career breaks, no children . Have worked for the last 20 years after being diganosed with Bipolar , keeping the illness in check - working around highs and lows. Last Nov I had a heart attack and my Bipolar spiralled out of control for a month as I was forever low. I continued to work but felt that I should leave work due to the heart attack and Bipolar.
I managed to get the Bipolar back under control and although I told the board that I felt I should leave, they did not want me to leave and changed my whole work pattern so that I could stay. I work 2 days in the office and 2 days at home and my 5 day week has become a 4 day week.
Staying has helped control the Bipolar and although I get tired and breathless I can rest whilst working from home. My company has been fantastic over all of this, and all my post heart consultations have been private as the company wanted me to use the insurance they pay for.It was my consultant that suggested that I apply for PIP. I answered truthfully and accurately - I get good days and then I get bad. The whole process has made me feel as if I have made this all up, that I am a criminal and wish I had never started this. The assessor has made me feel as if I am trying to defraud the system and continually referred to my "being better off than a lot of people and as I work why do i want pip" . I did explain that I believed that PIP was not means tested and that one could work - only to be told that people who work shouldn't get it. She actually asked for evidence of my heart attack ?
Part of me wants to contest the outcome just to ensure that working people can have problems and need this help but another part of me does not want to put myself through this as this will only agrivate my Bipolar and I really don't want to get to that dark place that is hard to get out of. Any advice please - Thanks in Advance

Hi Sharon,

I don't know if you're aware, but your full name is showing, and you're advised to change this to a "username" for anonymity.
You are allowed to claim PIP whilst working, so whoever told you that - it's utter nonsense!
Also, I do believe there are scans that can prove if someone's had a heart attack, but why would you lie about something so serious, you wouldn't - so me personally, I'd say it's down to them to disprove it! Keep fighting until the very end girl, you got this! :)

Chris.

Will do though I am not too confident after speaking to the solicitor today. It is true that currently the ISA money in inaccessible but it is not the same as the 5 year bond as the ISA would be accessible if we had financial powers. So it isn't "locked" as such. Though the solicitor genuinely doesn't know how DWP will view this so I can only wait to see what they say. And the solicitor is happy to write a letter to confirm the position. I suppose DWP might take the view that we should have moved the money before the guardianship was awarded. Or got financial powers. This has come about due to an oversight on our part really. Worth a shot though! Will definitely let you know what happens right through to conclusion. For anyone else that might be following my story so far the details are: UC closed claim 17th Jan 2025 UCD68 received 22nd jan 25 re civic penalty for late reporting of capital I replied by letter to the Freepost address the same day. I submitted handwritten MR also 22nd Jan, pointing out capital had never exceeded 16k with COL payments. I informed that there has been under-reporting of capital dating back to 2019 due to my not reporting unspent money in the current account. 16k had never been exceeded at any point though. 27th jan, i phone UC to see if they received MR. They had not so I did a telephone one there and then. 3rd Feb I go to the Post Office with a copy of my first UCD68 response to send recorded delivery, just in case they never got the first one. Unable to send recorded as no post code. Posted it anyway to freepost address. 10th Feb - now having 2 addresses with postcodes for UC, i send typed MR letters, detailing capital in the account with COL plus extra bank statements. I post both by signed for delivery on 10th Feb. One is received 12th Feb. The other 13th Feb. 19th Feb, i receive a call from a UC agent (possibly local as Scottish accent) He said he'd just finished loading my handwritten MR onto the system and was calling to let me know. Nothing further has been communicated by post or phone. They cannot calculate anything til they get all bank statements so I guess the DM has not looked at it yet.

Good heavens! You MUST contest this! The assessor was out of order with her comments - a complaint about her might be in order too. Very unprofessional to be making comments that you're better off than some people. She is supposed to assess you on the standardised criteria - not by comparing you to other claimants!
