i asked for my award to be looked at again and they sent me for a medical i was on high rate mobility and low rate care as i am a lot worse now i need az lot of help, so i thought my medical went well untill i got results today and found that the dr(atos) has compiled a completely inaccurate report about everything saying that i can walk normally and need no help he says i can walk more than 100meteres when he was told 30m b4 i have to stop i can dress myslf get myslf to the toilet i have not been able to do anything for 16yrs im near enough house bound yet they say there is nothing wrong with me i have sent a letter stating i want to appeal and sent it recorded delivery , even more of a problem that same dr has done my war disablememnt pension award as well so ive got a feeling im going to lose every singl;e bit of income i have, my head is well and truelly done

has anyone else had the same done to them ?

Pac, I don’t know if it will help, but if you appealed the war disablement pension decision or if it was related in some way to your DLA the following may be of use.. the Medical Services Contract (Atos/DWP)

4.1.10 The CONTRACTOR shall ensure that the following persons are excluded from examining a Claimant or providing advice.

4.1.10.2 any Health Care Professional who has regularly attended the claimant

4.1.10.5 anyone previously involved in advising or examining on a claim that has resulted in an appeal, in relation to the Claimant

4.1.10.7 anyone who has attended an examination as a witness in relation to this Claimant etc etc ..

update i have requested copies of both medicals and unfortunatly my army medical papers has gone b4 there drs to consider so it was to late to pull them , as for dla well here goes an appeal

how can they get away with such blatant untruths

can they be held accountable if so how do i do it

would a letter of my carer help saying what help she gives me be of any benefit

well i hope they can sleep soundly in there bed tonight as now i have to live on 55 war disablement pension a week so thats me now housebound for god knows how long
sorry forgot to put my disablility i crush fractured 2 discs l4 and l5 and one vertabrae ive had one op which was a waste of time as just made thing worse and now i have a form of atheritus(cant spell sorry) in the back

a war pension is awarded after reports and often a medical first for two years then often a letter is sent saying its indefinate and they will not look it again unless you ask them to carry out a review, you here claim by some in the DWP of false claims for IB DLA ect being high, while the dwp themselves say war pensions is very low, and the only areas where there is some fraud is allowances ie unemployability but working and widows but re married

if your pension is pre 05 too the way a pension is awarded is so different than the way dla or IB is claimed I am not sure how you think they could stop it. you need to contact the Legion to prtoect yor pension info here

sorry forgot to put i my disability is 2 crush fractured discs l4 and l5 and the vertabrae basically i cant bend at the waist i have numb legs feet the drs wont operate again as its to risky as the 1st op failed it just made everything worse now my legs feel like the on fire all the time my back looks like it has a football on the back its that swollen

Hi,

Firstly, if I can just reassure you, all decisions on elegibility and entitlement of War Disablement Pensions are made by medical officers directly employed by the Service Personnel and Veterans Agency, not by ATOS EMP's (visiting doctors) who carry out the actual visiting medicals. On my most recent course over at Norcross, we again discussed at length with the SPVA Medical Officers the situation and quality of the visiting doctors reports, so they are aware of the situation. Sadly the contract with the SPVA for visiting EMP's still has time to run.

Sadly though, your case is not unique in that some War Pensioners are tended by the same ATOS Doctor for both War Pension claims and also DWP claims.
Incidentally can I ask if the War Pension medical was in connection with a 'timed' award ending, as a result of you asking for a review?.

However as Dave has kindly pointed out in his links, should the War Pension related medical lead to either a reduction or no increase if you asked for a review, the decision is appealable. As a RBL Case Officer myself I know how long this can take though, so, another way around it (and to be honest yours sounds a very good case) would be to take it to your local Veterans Advisory and Pensions Committee (VAPC - formerly called War Pension Committees). They will look into your case in what is known as a 'Panel case' and make recomendations to the SPVA based around it. They will also take up your complaint about the visiting doctor as well. The more complaints the VAPC's receive about the quality of visiting doctors the better in my view (I speak as a war pensioner, RBL and SSAFA Case Officer and VAPC member myself).
