Interestingly the first job was working at home as a telephone adviser in the evenings I’m not sure I mentioned that.
Thanks for your kind remarks. I think one of the problems from all this is that if a person has mental health issues if they do any work paid or unpaid potentially puts them at risk on basis of this argument of incompatible with DLA. It seems to be if you can do work which requires the application of knowledge or intelligence means or the capability to look the information up raises this incompatibility. It seems that this is another example of the stigmatisation and discrimination in relation to mental health
It simply makes no sense and I hope that at the end of the day there will be a successful outcome both before the Court and before the Commissioner (Upper Tier Tribunal).

sorry to hear your prob, so was you claiming incapacidy benefit with the sevre disabled benfit alone side housing/ council tax benefit as well as dla ?. because i was lead to believe that you could claim dla and do work in certain situations.
I was only claiming DLA once I started work.

Hi Ron,
Why did they say that he nature of the work would disentitle you from getting DLA ? I could maybe understand if you were doing a job that involved a lot of physical activity, but why should acting as an advisor mean that you can't get DLA?
Well thats my point. It seems if you have any degree of intelligence the resumption is you can't suffer from MH problems which is nonesense.

I despair. A friend spoke to an expert in the field who said the case had been approached wrong and the case has been brought out of time.
I've decided the sloppy way my case has been approached means that there could be a miscarriage of justice if I am not careful and I therefore intend to change solicitors.
I thought the timely issue of proceedings point was fairly straightforward but he could not understand the argument preferring to accept that date relied upon by the DWP has to be the last day of the offence where in fact it cannot be. In effect the position adopted is that they must be right.
Anyhow thought I gave an update.
