A quick question, that I should have asked earlier :(

Which ESA criteria were you assessed under, the new ones, which started 28/03/11 or the old ones?

My test was on 27 april 2011 so I presume that would mean it is the new one?

Did question 1 on the ESA50 use walking or mobilising?

It's important as you need to be using the right criteria on your appeal submission. For example, picking up a box on the new critera does not require the use of your hands at all, whereas the old criteria, requires it to be done with both hands!

I'm guessing you did not copy your ESA50 before returning it! Did you receive the ESA50 after 28/03/11? When did you have to return it as this is normally six weeks after issue?

The liklihood is that it was the new criteria, but the dates are close enough that it could have been the old.

You can try ringing the DWP and asking for a copy, failing that, and assuming you appeal, you will receive a copy as part of the evidence pack.

I know how bad hypos can be, I had an Industrial Accident a few years back when a roof I was working on caved in; so after a 28 feet drop I was left pretty well knackard and severe nerve damage and blind in one eye.

in 2008 I got type1 diabetes with background retinopathy which made me keep tight control on my diabetes because I have only one eye left.

Well I started getting numb hands and feet Ive not wore socks for years now this with my nerve damage in my back was driving me wild so the consultant sent me to see a nerve specialist and it appears I now have diabetic nerve damage (just when I thought it could not get any worse).

now trying to stop this getting worse I keep a very tight grip on my diabetes Im getting hypos all the time that I have now had to surrender my driving licence.

I have to send my form in on the 1st DEC and if im put into the work group I will be contacting my MP and asking him to raise this; My Doctor knows Im not fit and a danger to myself and other, I know Im a danger. So will I be exempt from the law if I am forced back to work and someone is injured as a result.

Diabetes is totally unpredictable and as your blood sugar lowers so does your brain function and you slowly are heading for a coma, I do blood tests 10 times a day but even after a meal is you can just go into hypo; its like a car accident you can be careful all you want then BANG out of the blue you have a smash.
