turned down support group

hi

got letter this morning to say they have not changed the minds and I am still in the WRAG. so now its going to the tribunal.
reason for no reconsideration is
despite the clients problems they are still able to go to the supermarket and use their car !!!

also what does LCWRA mean as this does not apply and LCW category should still apply

I cant believe because I go sometimes go out and drive I dont go into the support group


anybody else had this said to them?

Hi C,

LCWRA = Limited Capability for Work Related Activity.

If a claimant is deemed to have LCWRA, it qualifies them for entry to the Support Group.

LCW = Limited Capability for Work.

If a claimant is deemed LCW then they would qualify for the WRAG.

Of course a claimant who was deemed LCWRA, would also be classed as having LCW.

Please be aware, that it is not simply the "going to the supermarket" that they take into account, it is all the actions involved, e.g. walking, pushing the trolley, putting items in the trolley, interacting with people, paying, use of money or credit card, unloading the trolley, etc, etc, etc.

A lot is "Assumed" from being able to do this.

Also, for a claimant to be classed as being able to carry out any particular action, they must be able to do it, for the majority of the time, without suffering severe pain and discomfort, repeatedly, reliably and safely, with reasonable regularity.

I suffer from mental health problems, anxiety depresion panic attacks social phobia
since i sent the reconsideration in I have had a relaspe and have now got a mental health social worker who comes to see me once a fortnight, my gp rings me once a fortnight and i am on long term assessment for mental health team.
all of this they do not know as I sent it back before all of this happened.
so now its gone to appeal without them knowing all of this? what should I do

And what if the "pain & discomfort " is more of a mental/mind nature, rather than of a physical nature? This is extremely difficult to convey to an assessor, or it can be. I found it to be so . To help an
assessor understand the mental processes
involved in a "shopping task" , for a person with mental health problems , isn't really a tickbox - type answer.

Hi Clio,
As I understand it, the tribunal will only be interested in how things were for you when you put in the claim, not how you are now. The recent exacerbation of your illness would count as a change of circumstances, I believe.
