ESA50 did not arrive - now my daughter can work!

I am writing on behalf of my daughter who is disabled. Her ESA50 did not arrive so after a few weeks she got a letter saying that as she had not returned her ESA50 without good cause she was deemed to be fit for work. How can she explain to them that she did not receive it?
Has this happened to other people? What are her options? Does she just need to appeal against the decision or can she request another ESA50 to fill out?
This really frightened me because it is very hard to prove that you have not recieved your ESA50. After all it is not signed for etc.
I would appreciate any help give.

Hi A,
I think this has happened to one other member, as far as I can recall.
The DWP are also supposed to send out a reminder letter, two weeks before the ESA50 return dealine if it was before the end of October 2011, (When claimants were allowed 6 weeks to return their ESA50) or 1 week before the ESA50 return deadline if the ESA50 was issued after that, where claimants are now only allowed 4 weeks to return their ESA50.

Did your daughter not receive the reminder letter either?
It is upto the Decision Maker to decide whether you have "good cause" for non return of the ESA50.
You should put forward any mitigating facts that may help.
Have you made enquiries to Royal Mail?, can you think of any reasons why the ESA50, and the reminder letter may not have arrived?
