You should have received a P45 when your IB claim was closed, unless you were tax exempt, in which case they are not always issued.it says I need a P45 on the form and sicknote, no P45 as its many years since I last worked, do I still need it?
also my local job centre kept my sicknote, I just put the jobcentre has it?

as far as I know I am not tax excempt, so this missing P45 will delay my claim?

It's a possibility, certainly for a new claim, the DWP would require sight of this and other documents, however, as your claim is not strictly speaking new, it is possible that it will not be required.as far as I know I am not tax excempt, so this missing P45 will delay my claim?
All I can suggest is that you continue completing the ESA1 and returning it, whilst pursuing the P45 in parallel.

its posted now, still no reply to the appeal tho. I hope they dont close the appeal when processing this new application.
Any idea how long I can expect to wait for a reply to the eSA form as well as my appeal which they recieved last 15th march.
It looks like I will have to get a crisis loan which I just rang up for but got told I need to wait until the 27 march for that. At least thats an 0800 number tho and they answer fast. Is funny they answwer fast when they paying for the call.

You should hear within a couple of weeks, but most DWP offices are running behind due to overloading, so don't be surprised if it is longer, you may need to chase them.

ok thanks. I rang anyway.
They said its not been sent off but will be soon, but here comes the next fun part. My sick note it seems has been lost/misplaced. The guy this time was polite and gave sympathy on how I been treated regarding the missed letter (Said he agreed with me but he doesnt make the rules) I said is fine wont debate that point with him as the decision is made, he then spent an hour or so looking for it and rang me back and said he couldnt find it so contacted my local job centre to find it and ring me back, that was 4 hours ago and no call back yet. I have preempted whatever may happen and rang my GP for a 2nd copy of the sick note, my GP says will bill the DWP for the time wasted and apparently he says its happening a lot. So it seems for the ESA claim I will need to hand in a 2nd copy of the sicknote, further adding to my costs travelling around etc. Of all my years dealing with the DWP they have never been as bad as this, its mistake after mistake consecutively.
In regards to the case number you gave me for the appeal I think I misunderstood you, you meant they dont need proof of delivery but only proof of dispatch? I would assume they cant prove that tho unless they have some internal logging system which I could argue isnt credible? since they dont send recorded/tracked. Am I right that if I turn up to the tribunal and the DWP have not bothered to supply any further evidence to their cause that I should win as long as they follow the previous ruling that you gave me. I am worried tho as the guy told me its possible my appeal wont be accepted by the tribunal service. In 4 days I will be applying for a crisis loan as its cler this ESA claim is probably going to take many weeks to sort out as well, probably lots of hoops to still jump through.
