So wouldn't the "panel" realistically ask the medical professional to explain conflicting evidence? What position would the op be in if they turned around and said it wasn't them in the recording?
As, as has already been stated, we are not aware of anyone submitting a recording, of any form, to a Benefits Tribunal, this is all quite hypothetical.
I think it quite unlikely that the panel will look to question the ATOS "doctor", as to them denying the validity of the recording, I guess this is a possibility, but again, this assumes that these are issues that a Tribunal will want to investigate.
It is worth pointing out, that one of the results of "destroying" the medical report, is that a new medical may be ordered by the Tribunal, which may not be to the claimants advantage.
