My disabled son (who receives DLA) has been on the assessment rate of ESA since July 2013 (approx. £56.30 per week). He has completed an ESA50 form which is somewhere in the system. (I phoned and asked) He wants to attempt to return to work in the next few months. If he does return to work having never been assessed does that mean he will forfeit the rate/money he would have been on if assessed as being in WRAG or support group?
Thanks for any advice on a way forward.

To answer your specific question first, he needs to close his ESA claim on the day before he starts work, he will not have to pay anything back and if he passes the assessment he will be entitled to back payment of the relevant group allowance from the beginning of week 14 of his claim to the date he closed it.

You say he wants to try working, has he looked at Permitted Work, this would allow him to work, within the restrictions, without having to close his ESA claim, see

Thanks Gordon, no he is hoping to go back to full time work, not permitted work as that is not possible with the type of work he does. When he closes his ESA will they still assess him for the time he was claiming it but at some future date.
