contribution based esa support group was created by Tommy Miner
i am on contribution based esa also placed in support group my question is i am recieving a mineworkers occupational pension and have been informed that income from my pension will be deducted from my contribution based esa support group is there any way to avoid this happening because i had no option other than take this pension at latest age sixty which i have had to do under the mineworkers pension scheme i thought that if i am in the esa support group all income ie pensions etc would be disregarded in relation to how much income i would recieve under esa support group also will pips payments effect my income from esa support group thanks for any guideance members can provide because it will have a big impact on my esa payments is there any way of getting around this pension payment problem tommy miner

Hi Tommy,
I'm afraid the only income that does affect contributory ESA is an occupational pension. Don't ask me why, I suffer from this too. If your ESA and pension take you above the personal allowance, you will have to pay tax too.

If the terms of your pension plan mean that it comes in to payment at the age of 60 then I don't think there is any way that you can avoid it being taken into account in regard to your ESA(CB), being in the Support Group or the WRAG has no bearing on the matter, even if you were able to defer the pension it is more than likely that the DWP will regard it as Notional Income and still make deductions.
There is an £85/week disregard followed by a £1/week for every £2/week in excess of the £85.
You should also be aware that this may also affect your tax status. ESA(CB) is liable to tax so it is possible with the addition of your pension that you will exceed your Personal Allowance and be liable to paying tax if this has not already happened. You need to contact HMRC about the changes.
