I suffer from Angina, COPD, OSA and Hypertension I claim DLA for mobility, I was claiming Incapacity Benefit until ATOS in their wisdom found me fit for work. My payments stopped in June 2013 I was 60 in September 2013 and ceased trying to claim anything as I has lump sum payments from occupational pensions.....however that cash is now running low . I want to know what I will have to do to start to claim again will I have to get sick notes as I am still no better health wise or will I have to sign on for Jobseekers even although I'm not fit for work.

You can make a new claim for ESA, you will need to provide a current Fit Note for it to be progressed. Have a look at our ESA Claim guides for details of the process and the eligibility criteria.

You will only be entitled to ESA(IR) as your NI Contribution history will not allow a claim for ESA(CB), this is dependant on your household income, assets and savings and any hours that a partner works.

24 hour work rule for ESA(IR)

There may also be questions over how you have disposed of the pension lump sum, but you should tackle this if and when it happens.
