Call for Reassessment Without Filling Out ESA50 was created by Asbo
Hi - a friend of mine is in the Support Group. She's been in there since 2012, then reassessed 2013, filled out form and then in 2014 someone spoke to her GP (from Atos) about her situation. But that was months ago. The latest thing is she has been asked to attend a Face To Face interview on an industrial estate even though it's on record that she can't get to local Job Centre even. Have you heard of people being called in for F2F interview without being sent an ESA50? Any help or clarification appreciated. Thanks

It's not clear from your post whether the form you refer to was in connection with the 2013 re-assessment or was issued subsequently?
If the form was issued after the last Decision, then whilst it has been a long time it is not impossible that the F2F is in regard to this form, whilst the queues have been reducing we have heard of claimants waiting 15-16 months from submitting an ESA50 to being asked. If a form was issued then it might help if your friend was to provide an update of their current limitations to ATOS with a copy to the DWP.
We have seen a number of claimants being invited to a F2F without an ESA50, this clearly disadvantages the claimant, unfortunately the legislation is not entirely clear on whether this is legal or not, it is potentially covered by an implied statement which would suggest that it is not, but this may be subject to interpretation.
Our advice to anybody in this situation is to complete and return an ESA50 if there is time before the appointment, if there is not then it may be best to submit nothing, an ill prepared ESA50 may do more damage than none at all and it would always be possible to question a Decision made by the DWP where no ESA50 was returned.

Thanks Gordon. I got the feeling that this wasn't to do with her 2013 reassessment - that she'd been assessed then and stayed in the Support Group. Of course, I will pass the info on and check that is the case

hi i got the same letter last week for a ftf in around 3 weeks time . i did however fill in an esa50 form and a photocopy of all my medical letters from consultants hospital etc and sent them the other day registered post . i also stated with it ,that even though one had not been asked for i was sending one so that they could read it before hand . that way they cannot say no medical information was given .
