I completed a PIP assessment form in .october, I was awarded low rate. Since then I have had cancer of the bowel and had half of my bowel removed and am on chemotherapy. I am due to have a chest thorax xt scan and may have to have nodules removed, I still have to have polyps removed from my bowel in about 3 months.
I sent in a further letter stating that my conditions have worsened and cannot do as much as I used to. I was advised to appeal but they say that they never received my letter and my appeal would only be on my original complaints, I have had to cancel my appeal and start the whole process again, surely this is unfair that I will have to wait a further 4 months.

You should not have been told to "Appeal" !!

A request for a Mandatory Reconsideration (Appeal) of an adverse decision will only re-look at how you were at the time of the adverse decision that you are challenging.

Therefore, as it seems that you had not been diagnosed with the cancer in October when the adverse decision was made, it would be hard to use the cancer as part of an MR/Appeal unless the symptoms could be tied in to the time of the decision.

Once you informed them that your conditions had changed/deteriorated, this should have been classed as a Change of Circumstances, (C of C) and should have triggered a Review/Supersession of your PIP.

Do you have proof of posting and receipt of the letter, if so this may help.

You need to re-write, informing them that you are reporting a C of C, giving details, and a copy of the other letter that you sent.

Sending Documents to the DWP.

You can request that the start date of The Supersession should be the date that they received your previous letter.

If you have no proof that the other letter was sent and received, you may struggle with proving this.
