Applied for enhanced rate, but was declined they agreed I had deteriorated but just extended the term, I telephoned for mandatory reconsideration 18 weeks ago I called today because I had heard nothing only to be told that they had a record that I had called but no notes had been passed on, so basically I would of been waiting for ever because no one was going to call me. This has now been sent as a priority and a complaint and I'm supposed to be receiving a call within 3 hours although it's 9 hours since I called and within 5 days to speak about my complaint I'm not holding my breath, does anyone have any advice, thank you in advance

Even though the DWP have acknowledged the MR request I would confirm this in writing so that it does not get "lost" again.

You say that you applied for the Enhanced rate, when you reported the Change of Circumstances, did you provide evidence of how your conditions have deteriorated? Where did you expect to score the extra points?

Have you requested a copy of the assessment report (assuming you had a face to face).

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

Hi thank you for getting back to me the mandatory reconsideration remain silent unchanged I scored 10 for the mobility Imy unable to drive anymore because my condition has deteriorated but they have made no mention of this other than to say they consider I can plan a route or journey unaided even though I stated I never go out alone I'm so confused by it all can you help

Did you explain and supply evidence for the reason(s) you never go out alone?
Just saying it won't be enough.
Unfortunately the criteria for mobility have tightened somewhat under the WCA.
You may need to ring again on Monday to chase up the MR and I would put it in writing as well if it was me and file the formal complaint.

I asked for a reconsideration of my PIP award because my condition had deteriorated, Atos visited me at home agreed that I had deteriorated since my last assessment and wrote to me 6 weeks later to say the rate would stay as standard but the term had been extended, I asked for a mandatory reconsideration because a few points had been totally overlooked that were discussed during the assessment, 16 weeks later I'd heard nothing so phoned the DWP and was told that my call had been logged but the task which was the points I had raised had been overlooked and my request was just logged as a call they apologised perfusely and said it would be logged as a complaint and made a priority, I would have a decision in 3 days, do weeks later after telephoning everyday I logged a second complaint, this time a manager called me within 24 hours apologised again and said the same thing had happened she assured me that I would have a decision by the end of the week this was Monday and I could telephone on Friday for the decision, I called and the decision was exactly the same as it was before so I'm left thinking nothing was done with it and it was just passed from one desk to another and just left because this had gone on so long and by their own admission the DWP had messed up more than once on this.
My questions are if I can see them, how do I see a copy of the first assessment notes, again if I am allowed to see them how do I see the mandatory reconsideration notes
I plan to take this to a tribunal and need advice as to whether I should ask for a decision based on my paperwork or whether I should attend the tribunal hearing, I hope you can help I feel at my wits end sorry this is so long but I wanted to give you as much background as possible
