Hi, I have applied for PIP. I have been granted the enhanced rate of the daily living component. I have appealled about the Mobility component as I meet the descriptors which state I cannot plan and follow a route of an unfamiliar destination unaided. They are saying that is not true. I have asked to appeal to the upper tribunal but have been told that this does not amount to an error in the law. What can I do, I feel like this whole process has been about breaking peoples spirit and ability to speak up for themselves.
In case you are not aware, your real name appears to be showing in the forum, if you want to change this then follow the instructions in the following FAQ
My full name is showing, how can I stop it? I'm afraid this is correct, appeals to the Upper Tribunal can only be made because you believe there has been an Error of Law, not because you disagree with the Decision.
The following FAQs explain this further and your options for pursuing it.
You don't say on what basis you hoped to score points for the Going Out activity but a number of members had hoped to do so because of physical problems following a route, I would not expect someone to score points on this basis as this is covered under the Moving Around activity.
