Help with reconsideration letter was created by Maria
Hi! I'm new to this site, was wondering if someone could help me to try and appeal for a friend who has had a medical and his pip has replaced his dwp about two weeks ago! Although getting pip he has lost his rate of dwp payments and basically lost money! He is wheelchair bound and has many other problems including epilepsy, incontinence, depression, scoliosis, two femur implants including to his hip due to his epilepsy and falls! He is left handed and broke his collar bone now has extremely limited movement to this arm and hand(left)! Is under the pain clinic and on high pain killers alongside many other medication! He can not take more than five steps without sitting down! Can not go outside alone, is escorted! Shopping, banking, housework is done by others! Also he needs help showering and dressing! He gets confused easily and can't plan! They were so cunning in the medical! They saw him in pain, they stressed him out! Told him he could talk, told him he could drink water, told him he shuffled in wheelchair! Therefore because he could walk indoors with a walker with a seat he could walk for one metre! Therefore he could go get his prescriptions, shopping, do housework and work out how to get to a journey unaided or escorted! WHAT! I am so lost as his carer I don't know what to do, this is so unusual for me, its had such an impact on my own health and I have to admit it I am angry and extremely scared! I have to face this but for once in my life I am struggling! Can someone please help me and guide me on how to write a reconsideration letter! I don't know how to begin and I am running out of time! Christmas has interfered with time to do this! I'm pulling my hair out, I have no one else to help family wise! There is just us too! Thank You!

Hi Maria

Merry Xmas.
Its very kind of you to offer to help.
You will find all the info you need in the PIP guide to appeals in the members area, accessible from the link down the lefthand side of any page of this website.
You can ring and request a MR but it is best to follow it up with a registered letter as the DWP can lose or forget phone calls. You need to do this within 28 days of the award letter.
The guide will tell you how to compose your letter. You need to request the assessors report if it hasn't already been provided and the decision makers report if it wasn't with the decision.
Once you have both of these you can go through and note where you think points should have been awarded. You say it states he can walk one metre. The benchmark is upto 20 metres so if he can only walk a metre he should have got maximum points for moving around? There is also the reliability test which says any activity must be done safely, repeatedly etc. Obviously your friend cannot repeatedly walk one metre. This sounds like a real stitch up. Have you got plenty of supporting evidence to reference. If not get some quick. You would probably benefit from reading the detailed claim guide in the members area as well to get help on how to expand the evidence on the claim form if he or you didn't use it when claiming.
