New evidence will always be better than old, but depending on the nature of your conditions older evidence may still be valid.

I was discharged as I was unable to access respite for the person I care for to enable me to have a prescribed operation, sadly.

Foss - Ive been told by someone who works for AToS that pip is not allowed to accept this evidence (a diary) it's all medical evidence or appointee info only with no plans to change.
How on earth do I get current medical evidence then? The last time I saw a GP was in 2012 and my consultant discharged me in January 2014.
It seems it is back to the drawing board

Hi
Don't give ATOS do not decide who gets benefit. They have no say over what evidence is acceptable or not.
The DWP PUBLISH ALL RULES AND REGULATIONS. The decision maker decides awards. They are not supposd to make a decision based primarily or mainly on the assessors report. They have to read all evidence submitted. If they make their decision and say your evidence cannot be considered due to its age you can use this in your appeal. If they make a decision which clearly ignored the evidence you can use this in your appeal. If your condition is stable and not likely to change new evidence would only be repetitive and uninformative.
Pleaae also see page 63 of the claim guide in the members area which says you should not have to obtain new evidence. If they need it they should write to your GP. Since you don't have one they should explain how they are going to overcome this.
You can still get access to the records from the hospital your consultant worked at.
You should try this resource for free legal help.

Personally I would sue the NHS for not providing me with a GP.
I would also sue the local suthority for not providing care for the person I cared for to allow me to have an operation.

Thank you for that - yes that is what I thought but you know... when someone tells you something better to check it to be careful.
Ah my dear Foss27, thank you for that - I tried for seven years to pursue a complaint against the GP practice - all to no avail - when NHS England was formed I was told they would undergo a full new investigation. Nine months later nothing had happened and they told me they would no longer investigate.
You cant sue someone unless you have a solicitor and you cant get a solicitor without legal aid and you cant get legal aid any more
As for my MP? Don't even ask. I honestly have tried everything - up to and including trying to sue/pursue ombusdman complaint against SS/NHS but to no avail, sadly.
Now I cant see and cant write and am too tired and busy to do anything but care. Ho hum.

Dear Nessie
I do not know if you are aware, but there was a new rule passed in April 2015, that you can now register as an out of area patient with a GP, the only problem is you don't get any home visits with it. I hope that helps.
