Hi Everyone, ok, last year i had my DLA to PIP transfer and i filled the forms in and sent them off. ( i was on high rate mobility and medium rate care) they sent for me to have a face to face and as is so often the case there was so many outright untruths and assumptions made that when the decision came i lost the mobility part but kept the care ( daily living?) part. i was gutted as i have to have a lot of help and always have to use walking aids and am on morphine and a variety of other tablets for the pain in my legI really didnt have the fight left in me to carry out the reconsideration so left it at that. Early this month i got a ESA 50 to fill in to be returned in mid february I saw my gp today and asked him if he would do me a supporting letter and explained how i lost the mobility last year. He said he will and he is going to put i cant walk further than25 metres without significant pain and also list my many other problems. My question is would it be worth writing to pip and explaining why i dont agree with there previous decision and enclosing a copy of the letter from my GP or is it too late? also would it put the other component at risk or involve another f2f? dont think i could face another one of those!

Hi Stickman,

If the PIP decision was less than 13 months ago then it is not too late for you to appeal. You would have to show 'good cause' for the late appeal and you would also need to be careful to show that any evidence you submit would have been valid when the decision was made. DWP/Appeals tribunal cannot consider any worsening of your condition that has come about since the decision - you would have to ask for a 'supersession' if you wanted to be reassessed due to a deterioration of your condition. A supersession would result in another PIP2 to complete and possibly another face2face assessment.

If you do go to appeal, you should be warned that both components of the award can be reassessed and it is possible for the benefit to be reduced or even denied.

As to your ESA claim, it is not enough to show that you cannot walk more than 25m, you must also show that you would not be able to self-propel a wheelchair - even if you have never had one and the use of one has never been advised by a doctor!
