Appeal Win!!

Thanks to all the excellent advice on this site, I was able to prepare throughly and confidently for the tribunal. It was a very fair hearing. I found the examples for the 'Grounds for Appeal' statement really useful and am happy to share mine if it would be useful.

I am now unsure whether I should just sit tight and wait for the DWP to contact me or whether I should send my statement of reasons from the court into the DWP. Could you advise please?

Many congrats on your win!!!

You could send a copy of your notice to the DWP to rub it in
You could ring and see if they have their notification.
They seem to take different lengths of time from a couple of weeks to several but you can keep ringing and hassling them if you want.

Do you mind me asking what the process was like?

I have a picture in my head of a big room with some very "judge" like people sitting in it and thats about it! lol

Does the DWP send a solicitor/ representative to make their case for them?

lotttytildy is most welcome to provide any feedback that may be helpful to other members !

The DWP do not always send a Presenting Officer (PO) and even when they do, they should only be there to present The DWP case to The Tribunal panel and assist in their understanding of the DWP's decision that is under appeal.

Any questioning should come from the Panel and not The P.O. !

Obviously, the Panel's line of questioning will vary from appellant to appellant.

Benefit Appeals Tribunals should be pretty informal affairs, where the majority of the questions commonly come from the Panel "Dr" !

With ESA Panels there will be two members, a "Judge" who may be a Solicitor who is fully conversant with Benefit Legislations and Tribunal Procedures, and a Doctor.

With PIP (DLA) Panels there will be a 3rd member who will generally be part the Disabled Community.

Even though some Tribunals are carried out in County Court Rooms , most are carried out in "Rooms" designated for use by Appeals Tribunals.
