My friend has been placed in the ESA WRAG, after a year in ESA support group - even though her epileps is more out of control than before, is under investigation for a possible blocked bloodvessel and has a newly discovered heart murmur - she has requested a mandatory reconsideration. In the meantime, she is instructed to attend the work programme she has been assigned to, and they want her to apply for work, and consider a work placement, even though her GP has immediately written a sick note with effect from the moment she was placed in WRAG - he says she is absolutely not fit to work. My question is, surely she would not be covered under any company's liability insurance, if she were to have a fit and be injured in a workplace? And that therefore, she cannot be expected to do work experience if she is uninsured? Am I wrong?

OK this will be difficult as you are not the claimant but we will do our best.

Although your friend was in the SG this will not be as direct result of her epilepsy as you cannot be placed in the SG due to this, the award must have been made for other reasons. Either way she needs to request the assessment report to see what she scored for. It will be the ESA85 if she had an assessment and the ESA85A if she did not, they can do this by phoning the DWP office that dealt with her claim, she should follow up the request in writing.

I'm afraid that GP's Fit Note will be of no use, she is already considered Unfit for Work.

There may indeed be Health & Safety issues associated with the Work Placement, but to be clear she is not being asked to seek work, the placement is simply to give her experience of a working environment. She needs to check whether the request is Mandatory or not, if it is then her refusing to comply could lead to her benefit being sanctioned.

When she has a better idea why she has been placed in the WRAG, then come back to the forum by replying to this post and we will do our best to help.
