Hello can anyone help went from long term I. B. To wrag group 3years ago sent letter of appeal plus letter from doctor was put into support group with no medical now all due to b and w guides the 3 years are now up and have been sent re assessment form there doesn't seem to be any new info on the up to date b & w guides for this renewal form I still have 3 years ago 's form willi re copy every thing the same I don't know where to turn next I an using the forum for help but not a lot of info on this renewal form can anyone give me advice please is any one out there who has filled in this form got any advice to give yours sincerely [E-mail address edited out. bro58]

You can use evidence from your previous ESA assessment, but you would have to make it clear that it is still relevant currently and if possible back this up with some new current evidence.

Although the last time the ESA Legislation was amended was in January 2013 you should still use our most current guides as this reflects any changes in the way that the Legislation should be applied due to any Upper Tier Tribunal Judgements.

Theoretically ESA is awarded indefinitely, (open ended)

However, in reality, each ESA awarded comes with a recommended period (The Prognosis) before it is reassessed.

The ESA decision notice letter that you receive after a decision, does not include the prognosis.

Normally, the longest period between re-assessments is 3 years !

So, it is normal to have to go through regular periodic re-assessments.

As you may know, ESA reassessments were being deferred from January 2014 but they restarted at the start of December 2015.

Just to make you aware that : The Centre for Health and Disability Assessments (CHDA) (aka HAAS) (Maximus) who took over the ESA WCA Contract from ATOS on 02/03/15 now carry out ESA Assessments/Re-Assessments.

There have been some changes to The ESA50 itself.

Now that you have The ESA50, you may want to consider :

You should treat this re-assessment as if it was your first assessment and not assume that The Assessor will have access to any of your previous evidence. They may not even know that you are currently in The SG.

It is therefore important that you reiterate how and why you still qualify for The SG, in that the limitations that you suffer as a result of your medical conditions have not changed nor diminished to such an extent that you no longer qualify for The SG.

Nor have you learned to deal with or adapt to your limitations since your last assessment.

If you are aware how and why you were placed into The SG last time, you could cite that also.

If you want to obtain fresh evidence such as a letter of support from your G.P., obtain it yourself and post it with the ESA50.

Do not rely on Maximus/DWP contacting your G.P. , even if you request that they do so.

They seldom do and are not legally obliged to do so.

I went from long term incapacity benefit to the work related group.
Thanks to your great help guides and an appeal letter from my doctor.
I was placed on support group without a medical and now three years later I have an assessment form for capability for work.
My condition has not improved.
I have a copy of the limited capability form from three years ago.
Am I able to copy everything onto the assessment form along with a new letter from my doctor?
There seems to be no change in the guides?
Will I get a letter from my doctor of all my medicine or copy of recent prescription?
Would be grateful for any help or assistance.

Hi WJ,

You can use older evidence from your last assessment as long as you can show that it is still current!

You can request a letter of support from your G.P., see an example of what may help : Here

Your G.P. is not contractually obliged to provide patients with such letters and where they do so, they may charge.

If your G.P. refuses you could request copy of your medical records which cannot be refused :
