PIP Denied was created by Pete1234
Received my PIP letter to day . Scored 0 on all points so PIP Denied

What bothers me is on the day of assessment at HOME my form states that I can walk 200 metres yet I never moved from my chair.

SO I have telephoned to appeal and Advised them that the assessment is suspect and suspicious
and advised them that gain that the maximum I can walk assisted is 5- 10 metres.

I was advised to write in a letter restating my case and problems and I said all you will get is a repeat of my form that I completed for them. It appears to me that they are carrying out a systematic wearing down process on people who are not fit enough mentally to tolerate their intimidation

The British people are being made fools by this government and some real pressure needs to be applied somehow.

I will keep everybody informed on how I progress through this stressful time but I am coming to the conclusion that my working life and dedication to this country means nothing to the powers that be.

You need to explain your reason for requesting an MR or you risk the request being rejected.

We recommend requesting an MR in writing, this needs to be done within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process and template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

When you have a better idea of the issues with your claim, come back to the forum and we will do our best to help.

Thanks for info Gordon.

I have already spoke to them on the phone, they are sending me the review so I can query it.

I have informed them that I will not write so they are reviewing the assessment as I stated that I was seated in my chair the whole time and did not even walk one pace or do any exercises.
I have also informed them that the maximum I can walk is 5- 10 metre with support.

So if this review fails they have said they will advise me how to pursue a tribunal and if that fails I am quite happy to employ a solicitor and go to court.

The onus is on them to prove what they have ASSUMED in their review.

I am 67 years of Age I had DLA for life as Doctors had examine me and you do not improve with health as you get older. I am under specialist I have
multiple conditions which I take many medications. I will enjoy pursuing and highlighting
this accusation of me able to walk 200 metres. It is about time this nut was cracked if people have completed forms which are stressful then to start having to write letters to justify what you are entitled to is positively demeaning. These assessors need to realise they will be old in the not too distant future and nature gives no exceptions to who you are The peole of this country are being fooled and it needs to stop.
