Am sure most will already be aware of this by now. However, after reading response, in particular paragraph below:

'This change will apply to new claims, claimants who report a change of circumstances and DLA claimants who are reassessed for PIP from 1 January 2017. The change will affect existing PIP claimants who do not report a change of circumstances from the later of 1 January 2017 or the date the Department reviews their current award'

I cannot get my head around the 2nd sentence, doesn't read correctly to me for some reason - 'The change will affect existing PIP claimants who do not report a change of circumstances from the later of 1 January 2017 or the date the Department reviews their current award.'?

Know it may sound daft, but could someone put this another way!

MT's.

Francis

The DWP are not known for the clarity of their letters and reports.

No one will be affected before 1 January 2017

From 1 January 2017 new claims and any reported Change of Circumstances likely to affect the award will be subject to the new rules.

For existing PIP Claims, providing no CofC is reported, then the new rules will be applied at the first re-assessment after 1 January 2017.

We'll need to see the amended legislation before we can provide a detailed update on how the changes will be implemented.

TY, Gordon.

That makes much more sense. Thank you for taking your time to put in more understandable terms.

What about those with an 'Ongoing award'.
Will it be an excuse to get those in sooner to re evaluate them to see if they will have a reduced point outcome ?

Hi pcm,

Only time will tell !!

Although with ongoing awards they should not really bother you again for at least 10 years, PIP Legislation states that they can review any current PIP Award at any time for any reason :

"Re-determination of ability to carry out activities

11. Where it has been determined that C has limited ability or severely limited ability to carry out either or both daily living activities or mobility activities, the Secretary of State may, for any reason and at any time, determine afresh in accordance with regulation 4 whether C continues to have such limited ability or severely limited ability. "

From : PIP Reg 11.

Hopefully they will leave you in peace !!
