My husband has been adjourned for medical reports. What happens if his condition gets worse between the assessment date and the appeal date? Do we inform PIP or do we have to wait until after the appeal? At the appeal we have to talk about his condition at the time of the assessment - if his condition is worse they won't be able to assess him as he was 7 or 8 months ago. If the appeal fails (please don't let it fail) do we then contact PIP about the worse condition?

I'm sorry that you and your husband are going through this :(

I'm afraid the appeal tribunal can only look at the situation as it was when the initial decision was made. That is because they are, in effect, remaking that decision, Although I realise that it is difficult to remember exactly how you were some months ago, any deterioration since the first decision cannot be considered.

What was that decision? Are you arguing against the lower rate or was PIP refused? Either way, you could - in theory - contact DWP about the deterioration straight away but - in practice- you might be better to wait and see how the appeal goes. That is because the new decision on the worsening condition would supercede the tribunal decision.
