Hi again,
I have my PIP tribunal hearing on Monday and I have just read through the bundle of papers, as I just haven't been able to face doing this any earlier.
I prepared 2 lengthy documents for the tribunal and submitted them both. One titled PIP Submission explaining why I believe I should be awarded specific descriptor points for all of the activities. The second titled PIP Consultation Report Form Submission literally pulling apart the face-to-face medical assessment report. With both I provided additional supporting evidence.
Having read the response from the DWP obviously they stand by their decision, which is no surprise. I did say that I would be making a formal complaint against Capita and due to this they have made no comment concerning my second document, which is a major part of my appeal.
So, can you please advise me on how best to make this complaint against Capita, meaning do I send them a copy of my second document complete with supporting evidence which to me feels like I am disclosing a hell of a lot of confidential medical information to an organisation that I have absolutely no confidence in? As previously stated this is a lengthy document because I literally pulled her report apart sentence by sentence. Or do a write a specific letter?
Also in readiness for my tribunal on Monday do I need to write a response to the DWP's response to my submission?
Any advice would be extremely grateful.

Good luck for Monday.
Re the complaint, you need to stick to factual matters, you may strongly disagree with many of the opinions that the assessor stated in their report, but being opinions you are arguing against their experience of completing quite probably, 100s of assessments.
On this basis you may need to create a third document or possible a précis of your existing one.

Having read someone else's post the other day saying that they had their tribunal in the afternoon but in the morning they received a phone from the tribunal service to say that they need not attend because their case had already been discussed and had upheld their appeal. I have been thinking about this and thought there was no chance I would have the same luck, especially as my tribunal was in the morning. However, I was just about to leave for it at 10.00 am this morning when the phone rang! The tribunal clerk had called to say "I am so pleased that I caught you before you left, because your case has been discussed and they have agreed to uphold your appeal. The letter will be posted out today and you will receive it probably Wednesday or Thursday of this week."
You cannot believe how shocked and elated I am feeling (although my mum keeps telling me to try and settle because if I become over excited it can trigger a hemiplegic migraine!) at this time. And I cannot thank Benefits and Work enough for all the help, advice and support you give to people such as myself. It has been a long slog meaning it is 11 months since my F2F assessment for PIP but despite all the stress and anxiety it has caused justice prevailed.
I hope this message gives others like myself hope that it is worth fighting for what is right and what you belief in.

This also happened to my wife, two hours before we planed to leave home for the appeal she received the same message. I think we had a strong case and feel strangely disappointed that we did not have our day in court as it were. thank you Benefits and work for your help and advice .
