Hi I have received my award letter which said I am entitled to standard rate care and low rate mobility, which means I lose my motability car as I was on high rate mobility Dla and medium care Dla, I'm devastated as I will be house bound without my car, I don't know whether to go to ma or not as I'm afraid to lose it all, also I will receive two thousand pounds transitional package from motability but I have just gone bankrupt before I receive it will I lose that transitional money, or will I be able to use it to buy a car as it will be for disability purposes I'm so stressed out any help is appreciated thank you

Hi Liz

I'm so sorry that you are to lose your car - very unfair when it leaves you so isolated.

I don't honestly think that we are in a position to advise you what to do about the transitional payment etc - it really isn't something you ought to do without taking specialist advice. The business of bankruptcy is so very complicated, and you do not need the added worry of going off in the wrong direction here.

If you feel you have a strong enough case, and that the assessment report was not a true representation of your situation with regard to your mobility issues then try for MR. Request a copy of your assessment report and see whether the points you were awarded are fair, and if not, make a note of why not and go on from there. The guides on the website will help you if you decide that this is the way to go.

Thank you for your help I will write tomorow for a m a and I am annoyed because the assessor has put down that I can walk an did walk 20 metres at the assessment, which is not true I used my stick, and stopped for breathe, took a seat in the waiting room etc, so at no point did I walk either 20 metres or at all unaided, it also said I was not distressed in the assessment when in actual fact I burst out crying at least three times an when asked I told her I was considering suicide, this,is also not put down, my question is my desicion letter has the reasons why I was awarded each points and why, is this the medical report or is the medical report what the assessor wrote not what the desicion maker has wrote in my award letter, I am a bit confused about that bit, thank you

It sounds like you have the Decision Makers Statement of Reasons this is sent as standard with the Decision Letter, it will be based at least in part on the assessors report, a PA4 if you had a face to face and a PA3 if you did not, you can request the assessors report from the DWP office dealing with you claim.
