Hi Gordon
I wonder if you could advise what to do if my MR for ESA not been considered, what my options are. As after 2 separate calls to dwp I have received different advices an what to do.
Shall I apply for jsa whilst appealing to tribunal or apply for tribunal and once the claim gets logged on the dwp will carry on paying to the assessment rate as prior to stopping?

Please don't post your questions in other members topics, it's not fair on them and can lead to the wrong advice being given or taken.

Sorry it's not clear from your post whether your MR has been complete yet.

If you are still waiting then I am afraid there are no time limits on how quickly an MR must be completed within.

If the MR has been done and the Decision has not been revised then you can request an appeal. Have a look at the ESA Appeal guide for links to the SSCS1 that you will need to complete and instructions on how to do so.

If you are still waiting for your MR then you can claim JSA while you wait. Once your claim has been accepted you can present a Fit Note for up to 13 weeks and be excused from any Job Search requirement.

If you make an appeal, then once the DWP have received notification of your request from the TS you can ask to be put back onto the ESA Assessment rate until you have a hearing.
