Hello,

I noticed when looking at 50 ways to challenge a PIP decision that the upper tribunal recommended a claimant should be awarded points for taking nutrition because of what she eats during the week.

Can I use this as an example of an upper decision or should I just write under the criteria why the assessment decision is wrong based on what I write in PIP2 from?

Thanks for any advice.

UT decisions are often more complicated than they first appear. In order to use one you would have to show that every element applied to you, which can be difficult. It is usually better to show how and why you meet the descriptors without referring to the UT decision.

Nothing on this board constitutes legal advice - always consult a professional about specific problems
