Partner has just been advised that he has been overpaid ESA (Contribution based) since 2013 as a result of DWP being notified by HMRC of work based pension and additional voluntary contributions being paid. He was retired from the NHS on capability grounds (ill-health).

We accept that he should have notified DWP of changes in income, we accept that the overpayment needs and can be recovered. What we do not get is why it has taken DWP from the end of the tax year 2013-2014 until now to advise of the overpayment of £600 plus.

Does anyone know if the DWP/HMRC have a responsibility to notify changes within each tax year? how long can the amount be paid back over? any recourse to appeal etc? any advice would be helpful

It's most likely the HMRC picked up the pension payments from your bank account and then informed the DWP. Have you had to notify HMRC of a taxable income?

The Decision should be appealable, but only on the facts of the matter.
