JSA and doctor's certificate was created by concunningham
A client has been refused ESA (appeal pending) as she did not score enough points.
I advised her to claim JSA and see her doctor and get a certificate to say she was ill so as to avoid being forced to look for work. She really is not capable.
The advisor at DWP has refused to accept the certificate saying it contained the same info as her ESA claim, which was refused.. Surely only a Dr can decide if someone is currently fit or not.
Any suggestions as to what to do next?
thanks

We see this quite often. Get them to ask the advisor under what JSA Regulation there is a requirement for the Fit Note to refer to a new condition.

They changed their tune once I challenged it.
