Severe disability premium was created by Andrew Stevenson
Hi I was told there is a rule where with severe disability premium where you need to live on your own but I hear there is a exemption if the person like a family member has a qualifying disability benefit

" you have no non-dependant adults living with you (unless they are also receiving a qualifying disability benefit or are registered blind)"

Now the parent has ESA and DLA
and the Non Dependant child has ESA and PIP

How does the claim work, it's there something on form to say person living with her is a disabled non dependant

There are two aspects to this.

To receive SDP a claimant needs to be receiving DLA MRC or HRC, PIP Daily Living or Attendance Allowance. They also need to be receiving or to eligible for an Income Related Benefit such as ESA(IR in order to receive payment.

They need to be living alone or considered to be living alone AND no one must be receiving Carers Allowance for them.

So from your post, providing the parent is receiving DLA MRC or HRC and the child is receiving PIP Daily Living AND no one else lives with them AND no one receives CA for them, then they both should be able to claim SDP.

If they are not receiving ESA(IR) then they need to contact the DWP and ask for ESA3 to see whether they are eligible for this and an IS10 form to receive the SDP, the latter ask about who you live with.

can I ask some clarification regarding the above answer.

if you fill in the esa3, and give details with it that you get PIP daily living/ no one gets carers allowance for you...........do you still have to fill in an IS10....and would they send this form automatically if awarded IR or do you have to request it?

The ESA3 is to assess the claimants eligibility for ESA(IR) , the IS10 is in regard the IS10, neither form is sent out automatically by the DWP although they sometimes send them, but they usually have to requested.
