Hi,
I read in your last news email that the government are being challenged on their recent changes on the 16 March regarding making it harder for people with mental health problems to get enhanced mobility.
Can you tell us:
Who is bringing this challenge?
What effects will it have on people already waiting for their appeal to be heard from tribunal?
Should their be a suspension of lower tribunal until the case has been heard by whoever is reviewing it?

I think you may have misunderstood the article
The challenge is being made by the Government against the UTT Decision that prompted the changes to the Descriptors in the first place.
It is possible that that pending appeals that are relying on the UTT Decision will be placed in abeyance until the matter is resolved, although we have not heard of this happening at the time of posting.

Yea your right I have misread this.
So what your saying is not only did the government overrule an independent judiciary after many years of confusion, they change the rules practicably over night and now come back to challenge the decision they stopped....
I'm right in thinking this isn't a communist state? Right? Better be quite the ' thought police' will be listening

Do the mobility changes apply from the date of the assessment or date of the decision?
If the latter is that the same date printed on the decision letters?
The PA4 form for my assessment contains old descriptors.

The changes apply to any Decision made on or after 16 March 2017.
The date on the Decision Letter is taken as the Decision Date unless the letter states otherwise.
