My son has passed his ESA medical and has been put in Workers group. Since then I have been awarded Attendance Allowance at the top rates as a disabled pensioner. He has now been awarded Carers Allowance for looking after me. He is still receiving ESA at a reduced rate, The Job Centre has now been in touch asking him to attend interviews. My query is can he be forced to go on a scheme as he has been on those in the past and completed them successfully although he was still getting DLA at the time. He currently appealing his PIP and is at a tribunal stage as he was awarded only 6 points.
So with all these bits on information and being a carer can they ask him to look for work or interviews? Any help I would be grateful for.
As he has an award of ESA he cannot be asked to work or to seek work.
If he is in receipt of Carers Allowance then he should be excused from any Work Related Activity, but this does not include Work Focussed Interviews which he must attend.
His JC+ advisor will no virtually nothing about his circumstances, so he will need to make them aware of his CA claim and his health problems.
