Hi all, I have been battling with the DWP for over 6 months regarding my ESA assessment to be carried out at my home. They have finally agreed to this. My question is am I legally allowed to video record the interrogation.....sorry...assessment, and do i have to tell them I am doing so?
You have no legal right to require the assessment is audio or video recorded.
A video recording will not be accepted under any circumstances.
You can request that an audio recording is done, this can be provided by Maximus or you can provide the equipment yourself, if the latter then you must be able to make two simultaneous recordings direct to tape or CD, digital recordings are not allowed.
There is a template letter in the ESA section that you can use to make the request.
