Medical assessment for PIP - was created by sue
please can you help. I had a medical in December 2016 and all of my points were removed. I was misquoted several times (and had a witness with me). I started a new claim and put on the form that I need a home assessment because I have psychosis. I also gave them evidence. They have sent me a new appoint for a medical (not at home). Can I request a home medical on any grounds or do I have to attend? If I attend could I record the medical so that I could use it at tribunal? I am convinced the exact same thing will happen - where the assessors lie. Thanks

You are very unlikely to get a home assessment without your GP writing to the Assessment Provider explaining why you cannot attend at their offices.
You can write to the AP to ask permission to record the assessment, you will need to be able to make two simultaneous recording direct to tape or CD, digital recordings are not allowed.

Hi Gordon
Please can you advise how I go through another medical with Capita and them lying about the answers I give. I experienced this personally in December 2016 and also when they assessed a friend of mine. I don't think I can get hold of a tape machine as you mentioned. How can I help myself?

Having a companion with you may help, especially if they can take some notes during the assessment, but even if they can't do that then they can collaborate what is said.
I'm afraid the bottom line is that you have little choice in the matter, as the assessment is the only way to progress your claim, what I would say is that despite your previous experience, the majority of assessors are professional and provide an accurate report of the assessment.

I am Tim, a friend of Sue and a law lecturer and I wanted to know more about why you think that she needs to make two simultaneous recording direct to tape or CD, because digital recordings are not allowed....... Please can you point me in the direction of the legal justification for your advice? Can you quote a specific law?

Because the DWP require it.
Claimants have no legal right to require their assessment is recorded, it is an accommodation granted by the DWP and they require it to be done as previously posted. Failing to comply will be treated as an unreasonable requirement and the claimant will be treated as failing to participate in the assessment and classed as failing to attend.
