Buying a home as a gift - would it effect IR ESA? was created by Carolasks
Hello,
A close family member has had to give up work due to disability in Jan 2017. After a lot of paperwork and assessments with thanks to this site - he has been awarded PIP Daily Living - basic rate until 2020, IR ESA and SDP in the support group, and Housing Benefit.
He is currently living in a privately rented home close by to family and friends - totally necessary as his support network. Landlord accepts HB thankfully.
In order to try a sense of a more permanent stability in relation to housing - it may be possible for his family to purchase him a very modest small home close by...£60k.
In other words - a gift to him from immediate family.
Am I correct in assuming this would not effect his PIP?
Main queries:
- would it effect his IR ESA and SDP?
- would he be able to claim for payment of Local Council Housing Rates (we are in NI).
He does not have any capital.

I'm afraid we can't give detailed financial advice on the forum.
The primary issue will be how the money is transferred. If the gift is paid directly to the vendor then there should be no issues, but if it is paid to the claimant for them to make the payment then it introduces issues of the claimant having capital and could result in their ESA and HB being suspended and even stopped.
I recommend that those involved get face to face advice before they proceed from a trained advisor.

The money would go directly to the vendor, not to the claimant.
