PIP Mandatory Reconsideration was created by Mackemlass
My daughter was awarded 7 points for daily living and 12 points for mobility. Mobility payment was backdated and she continues to receive this. On 17th June we requested Mandatory Reconsideration and are waiting to hear. We firmly believe she should get more points for daily living and realise we may need to go to Tribunal, which we're prepared to do.
We understand that if she is awarded daily living, either at MR or Tribunal stage, the payment will be back-dated.
HOWEVER.... and this is our question... We understand that the whole case will be looked at again, and if it is decided she should NOT have the mobility component (we don't think this will happen but are learning to anticipate the unexpected) will she have to repay what she has been given so far?
Supplementary question: Any idea how long MR decisions are taking at the moment?
What happens if, when they look at her case again, they decide she shouldn't have the mobility points? (We don't think this will happen, but are learning to prepare for the unexpected.) Will she have to repay all the money she has been awarded so far?

If, and we haven't seen this happen for some time, her mobility award is reduced or removed during the MR then I would not expect her to have to pay any PIP that had already been paid back, the fault would be the DWP's for not having made the correct Decision originally.
