Is there anything under the mental health act? was created by suemc
Just wondering Gordon is there anything under the mental health act I can ask them about because they keep extending my wait time for tribunal. When it was 11 wks they told me I had up to 15 wks, Now it is 13wks they have told me its up to 18 wks. I have BPD Epilepsy and triple hind foot fusion. Obviously I do not want to annoy them that much they will have pre judged me. But my moods are having effect on epilepsy my sleep is effected etc.

Also something else I ment to ask, In my bundle of papers awaiting tribunal hearing I remember someone saying there should be points of law. On mine there are none just leading me to the act where they changed DLA to PIP. There is nothing specific?

The DWP letter heading the bundle should include a list of all of the applicable legislation used in the making of the Decision, but beyond that I would not expect the DWP to quote any other references.
Are you referring to Case Law?

I am sure someone said there would be points of law where i would of failed, but it only states going back to the old DLA site showing the pip questions. I was also not asked how i cooked, and the question on nutrition was told by me for dementia patients, but now states I drink milk. I feel confident, and have took you advise of contacting MP. Whether this will heed or hinder me is a worry. But the waiting is destorying me from the inside out.
The emphasis seems to be on the assessors cabability, but i have sent in a letter from a consultant showing wasting of leg and bone loss in foot which clearly shows she never done a full medical on my lower limbs.
