Cervical Myelopathy and Radiculopathy -ESA was created by TheHud
Hi
I have been diagnosed with cervical myelopathy and radiculopathy, currently on the path to surgery. This has coincided with my ESA review rearing its ugly head.
I have looked at the guidelines in the ESA teaching manual and noted that these conditions merit a specialist nurse or pysiotherapist for the assessment.
Questions - has anyone had any experience of the assessment for these conditions?
- has anyone been given a paper based assessment?
- if anyone has, what is the realistic outcome given already permanent disability
from this and other conditions is proof provided?
- should I still put as much focus in the form for the older conditions or
concentrate on the latest new diagnosis.
My problems have been ongoing following a car accident 21 years ago and became disabling 13 years ago. I only applied for disability benefits 2.5 years ago. At the time my neck had still not been assessed as many other diseases were identified. This means that my existing ESA application (support group) was based on the other conditions and their limiting extent.
Many thanks

Nothing on this board constitutes legal advice - always consult a professional about specific problems

ESA is not about your conditions but the limitations that result from them and prevent you from completing the ESA activities, so I certainly would not limit yourself to only problems that result from your latest conditions.
A PBR can only be done if Maximus believe that they have sufficient information to do one, so their decision on this will be entirely down to the information that you include in and with your form.
I'm afraid a permanent disability is no guarantee of an ESA award, this is about your showing that you meet the ESA criteria.

Hi I am a 61 yr old male who was diagnosed with cervical myelopathy with MS and after my PIP assessment I was awarded basic on both accounts my ESA Assement didn't happen as enough information was available to put me in support group.
