When I appeal-and the DWP accepts it: I want to know if my original ESA50 application form(that I completed in February 2017) will be included in the the `bundle` of papers relating to my claim. for example , would it be included in a summary of the relevant facts, as detailed in in your ESA guide to MC and appeals Jan2016? Problem is I shredded it in error, so feel at a a disadvantage, as I did during the actual WCA,in July. Will I have to make a special request to get a copy of my original ESA50? I note on page 22 of the above guide it staes that the appeal papers prepared by the DWP may include some or all of documents relating to the case, may include...ESA50 questionnaire, but do I have to request under the data protection act as advised in the guide?
The DWP's submission will contain all of the evidence used in the making of the Decision, at the least this should include your ESA50 and anything that you attached to it and the assessment report. There may be other documents such as any reports that were sourced from your doctor or anybody else that included in the form.
