Hi, I had a phone call from DWP stating that ATOS have increased my mobility amount to Enhanced but Care is still the zero. Is there a way of accepting the mobility but still appealing care without putting the mobility component at risk? Part of me wants to accept just so its all over even thought I think I fulfil the criteria for standard rate care. If I carry on with the appeal will they look at both care and mobility or will they take into account ATOS change of heart? I don't really understand how DWP are contacting me when I sent the appeal forms to the Tribunal service? Advice please.
You can accept the DWP offer, this will lapse (cancel) your appeal, when the award is in payment then you can make a new appeal for the Daily Living component.
Just be aware, if you indicate that you will be doing this to the DWP then they will only administratively make the offer, but not put it into payment, the Tribunal may accept the DWP offer at your hearing but they are not bound by it and may decide that the current Standard Mobility award is correct.
