Upper tribunal was created by fiona brown
Hi I have lost my appeal for pip. I received 6 points for daily living. I am a carer for my son who has ADHD and the judge kept referring to the fact that if I could look after him I shouldn't be entitled to pip.
My argument is the points I qualify for have nothing to do with looking after him. I was given points for help with dressing and bathing and help with cooking before the appeal. I suffer from inflammatory bowel disease and was contested no points for help with toilet needs and incontinence, managing complex decisions and managing therapy for my shoulder after an operation.
Can I try for an upper tribunal appeal due to the discrimination that I am a carer?

straightup

You can't do anything until your have requested and received a Statement of Reasons from the Judge in charge of your hearing, see

Tribunals – Requesting a Statement of Reasons

Once you have this then you can see whether an Error of Law has been made in the Decision.

You might want to consider making a new claim for PIP, there is no waiting period and an appeal to the UTT could easily take a year for a new hearing to be convened, which is the most likely outcome from the UTT.
