Substantial Risk Regulations was created by Tree Frog
Hi
I am presently putting together an appeal against an ESA decision and wish to base it upon 'Substantial Risk'. Could you please advise what Regulations specifically I should quote? What are the latest Regulations? Are they still 29 and 35? I'm confused as to which year I should quote. Can you point me to an area on this site that deals with guidance on how best to appeal on the basis of 'Substantial Risk' please.

Thank you

Substantial Risk is explained in detail in the ESA Claim guides and in particular the mental health one, see

www.benefitsandwork.co.uk/help-for-claimants/esa1

If you still have questions after you have read these then come back to the forum.
