Appeal Judge just plain wrong? was created by VT
Represented a client today at Basildon - the thrust of my argument was that the Assessors report bore no resemblance to the reality of the interview (PIP) and directly contradicts the evidence given by the claimant. When I raised this the Judge immediately said "We're not going down that route". I looked astonished and he continued "We're not going to allow criticism of the Assessor".
ARE THEY THEREFORE FAILING IN LAW TO GIVE THE CLAIMANT NATURAL JUSTICE AS A RESULT OF THIS RESTRICTION? - WE LOST THE APPEAL BY THE WAY.

The panel are entitled to favour any evidence they wish providing they explain why they are doing so.

Are you going to request a Statement of Reasons from the Judge?
