2 and a half years ago I was up for renewal from DLA over to pip and it went to tribunal and I lost .... I re applied this year and found out 3 weeks ago I had won standard daily allowance and high mobility .... I have now found the evidence that back in 2005 when I had an mri on my back which stated I needed an operation on my back as I had a collapse lower back disc and a lower lumber pushed out to the left which states I was dibilitated Do I have a case to fight for back pay .... I have now had a new mri and get the results tomorrow ?
I'm sorry but I still don't see any opportunity for you to backdate this award!
Your only options are a Judicial Review which will require expensive legal council and you would be liable for the DWP expenses if you fail.
Or an Any Time Revision, however, this requires the DWP to accept that they made an error when they made the original Decision which seems remote given that you had an MR and an appeal.
